Terms of use

Please read these terms and conditions (“Terms”) carefully before using this or any of our other websites. If you are under 18, please get a parent or guardian to read through these Terms and Conditions and to discuss them with you.
If you don’t accept these Terms (note in particular terms 9 and 10) please don’t use or order from our websites. If you visit or use any of our websites and/or place any orders with us you will be bound by these Terms, and they will form a contract between you and us.
These Terms apply to the entire contents of the Community Woodland Network and to any correspondence by email between us and you. Our Privacy and Cookie Policy doesn’t form part of these Terms but should be read also. Some parts of our websites may also contain additional provisions which apply in addition to these Terms.

  1. Changes

    We may change these Terms at any time, in which case the amended Terms will be posted on our websites and will apply from the date we post them. Please check these Terms on each occasion you use the Community Woodland Network . If you continue to use our sites you will be bound by the latest Terms.

  2. Using our sites

    You agree to only use our sites in a manner that complies with all applicable laws and regulations and is consistent with these Terms and does not infringe the rights of anyone else, nor restrict or inhibit their use and enjoyment of our sites (including, amongst other things, hacking). We reserve the right in our sole discretion to deny any user access to any of the Community Woodland Network without prior notice.

  3. Registration

    You may access and use most parts of our websites without registering your details with us. Before you can take part in our message boards/discussion forums, or otherwise post comments to our websites you will need to register with us. If you choose to register with us, each registration must be for a single user only. Please ensure that the details you provide us with are correct and complete, and inform us immediately of any changes to the information that you provided when registering. You must make sure that you keep your password confidential. This means that you must not share your password or let anyone else access your account. Always ensure you log out of your account at the end of your session to avoid anyone else using it. You should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if your password is being, or is likely to be, used in an unauthorised manner. We may disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these Terms.

  4. Privacy and cookie statement

    We use, store and process information about you in accordance with our Privacy and Cookie Policy. By using our Community Woodland Network, you consent to our use, storage and processing of your information in accordance with that statement.The Woodland Trust reserves the right to share data related to your community woodland project and your individual use of and activity on the Community Woodland Network with third parties for the purpose of evaluation. By evaluating the network we can improve the service we offer to you and secure additional funds to support our work and activities.

  5. Community Woodland Network content including user-generated content

    If you have a complaint about any content on (or sent via) the Community Woodland Network please notify us immediately by email at communitywoodland@woodlandtrust.org.uk. Please note that no action can be taken until we receive a fully completed Report content form.

    • You must not post or transmit to the Community Woodland Network any material:-
      • That is knowingly false or misleading, defamatory, illegal, abusive, vulgar, hateful, harassing, liable to incite racial hatred, blasphemous, discriminatory, pornographic, sexually oriented, threatening or invasive of a person’s privacy;
      • Which you do not own or for which you have not obtained all necessary licences and/or approvals;
      • Which is technically harmful (including, amongst other things, computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious software or harmful data);
      • Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with anyone or any entity.
    • If you post or transmit to the Community Woodland Network any material of the type prohibited under term 6.1 above (or which otherwise results in a claim or action against us) and we incur any costs, expenses, liability or losses as a result, then you agree to indemnify us for all such costs, expenses, liability and losses.
    •  If you post or transmit any material to the Community Woodland Network (“contribution”):-
      • You grant us a non-exclusive, perpetual, royalty free, worldwide licence to use, highlight, comment, modify or reproduce your contributions in whole or part, in whatever form, on our websites, social media pages and other communications and publications;
      • By submitting a contribution you waive your moral rights including the right to be identified as the author of the content;
      • You grant us the right to use the name that you submit in connection with that material; and
      • We shall be entitled to reveal your identity (or any information which we have about you) to any third party who claims that any of that material violates any of their rights or to any government or regulatory authority that is entitled or requires us to do so.
    • We may remove or edit any material or posting you make on any of the Community Woodland Network at any time.
    • When contributing to forums or discussions, you must abide by the forum rules at all times. (Please find the forum rules stated below).
  6. Intellectual property rights

    • You acknowledge that all copyright, trademarks and other intellectual property rights in the Community Woodland Network and all photographs, footage, designs, images, text, software, data and other material in our sites or generated by our sites are owned by us or our licensors. You are permitted to use the sites and this material only as expressly authorised by us.
    • You are permitted to print and download extracts from the Community Woodland Network for your personal non-commercial use and for private study, provided in each case that:
      • Copyright and source indications are also printed and copied;
      • No modifications are made to the materials and they are not used as part of any other publication;
      • Any document is printed and copied entirely and is not used in a derogatory or misleading context; and
      • The material is not used in a manner which may damage our reputation or otherwise be harmful to us or impair our ability to achieve our charitable objects.
    • No other use of material on the Community Woodland Network may be made without first obtaining our written permission. In particular, you must not do the following unless you have first obtained our written permission:-
      • Incorporate any material from the Community Woodland Network in any other work or publication, whether in hard copy or electronic form; nor
      • Make any commercial use or publication of any material on the Community Woodland Network (other than as necessary for the purpose of viewing the sites in the course of business).
    • If you wish to use any material from any of our sites other than in accordance with term 7.2 above please email your request to communitywoodland@woodlandtrust.org.uk with the subject line “Permissions request”.
    • The photographic, text and other graphic images within any products or publications supplied to you are copyright works and none of them may be copied, reproduced, licensed or otherwise exploited.
    • The Woodland Trust name and logo are trademarks of the Woodland Trust. Other logos and names used on our sites may also be the trademarks of the Woodland Trust or their respective owners. No permission is given by us in respect of the use of any such trademarks, names or logos and such use may constitute an infringement of the holder’s rights.
    • Whilst we encourage our supporters to campaign on the issues referred to on our websites, unless we have specifically authorised you in writing to do so please do not imply that you are taking action on behalf of the Woodland Trust and in particular do not state that the Woodland Trust is taking, or proposes or is considering taking, action against individuals or organisations, for example, a boycott of a company’s products.
    • Any rights not expressly granted in these Terms are reserved.
  7. Advertisers and sponsors

    We may from time to time allow companies to advertise goods and services on our sites. Whilst we will not knowingly run an advert that is untrue, or which relates to goods or services contrary to our objects, the appearance of an advert does not mean that we endorse the advertiser’s goods or services. With the exception of products sold on the Woodland Trust’s website, we are not responsible for the accuracy of any advertising material or for any advertised product or service.

     

  8. Disclaimers

    • Information in the Community Woodland Network should not be considered as a substitute for advice covering any specific situation. We do not warrant the accuracy and completeness of that information and we will not be held liable for any errors or omissions. The material on the Community Woodland Network may be out of date, and we make no commitment to update such material.
    • We do not warrant that the functions contained in the Community Woodland Network will be uninterrupted or error free, that defects will be corrected, or that our sites or the servers that make them available are free of viruses or bugs or represent full functionality, accuracy or reliability of the materials. We will not be liable for any loss, disruption or damage to your data or your computer system or any other damages (including amongst other losses, loss of profit or loss of use) arising out of your use or delay or inability to use our sites, their content or any link to another website arising in contract, tort (including negligence) or otherwise except in the case of death or personal injury caused by our negligence.
    • Party political or any other views and opinions expressed in the Community Woodland Network do not represent the views or opinions of the Woodland Trust, which is a non-partisan conservation charity. We encourage open debate; however, comments or opinions expressed are attributable only to the individual contributors.
  9. Liability

    • We do not limit in any way our liability for fraud or death or personal injury caused by our negligence or breach of statutory duty or any other liability which cannot be excluded or limited under applicable law.
    • We will not be liable for any loss or damage caused by us or our employees or agents in circumstances where:-
      • Loss or damage was not reasonably foreseeable to both you and us when you commenced using the Community Woodland Network or when a contract for the supply of products by us to you was formed;
      • Loss or damage was not caused by any breach by us, our employees or agents; nor
      • Loss or damage relates to your business (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure).
  10. Links

    • The Community Woodland Network may contain links to third party websites. Such links are provided for your convenience only. We do not control such websites and are not responsible for their contents. The mere inclusion of such links does not imply any endorsement of the material on those websites nor any association with their operators. If you decide to access any of the third party websites linked to or from the Community Woodland Network, you do so entirely at your own risk and we are not responsible for any damage, loss or offence caused or alleged to be caused by or in connection with the content, information, advertising, services or products available on third party websites. We cannot guarantee that these links will work all the time and we have no control over the availability of the linked pages.
    • If you wish to link from your website to any pages of the Community Woodland Network you may do so only on the basis that you link to, but do not replicate, the website page, and subject to the following conditions:-
      • The linking text must simply consist of the website address;
      • You do not remove, distort or otherwise alter the size or appearance of any logos on the Community Woodland Network;
      • You do not in any way imply that we are endorsing any products or services;
      • You do not misrepresent your relationship with us nor present any other false information about us;
      • You do not otherwise use any Woodland Trust trademarks displayed on our sites without our express written permission;
      • You do not link from a website that is not owned by you; and
      • Your website does not contain content of the type referred to in term 6.1 or that does not comply with all applicable laws and regulations.
    • At any time and at our complete discretion we reserve the right to withdraw the permission to make website links to the Community Woodland Network.
  11. General

    • If any provisions of these Terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any country which apply to these Terms, then so far as these Terms apply within that country in which those provisions are illegal, invalid or unenforceable those provisions shall be severed and deleted from these Terms and the remaining provisions of these Terms shall survive, remain in full force and effect and continue to be binding and enforceable.
    • If you breach these Terms and we take no action, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach these Terms.
    • Events beyond our control – We will not be liable to you for any delay in delivering any services or for breach of our obligations, if the delay or breach is due to acts of God, civil commotion, riots, malicious damage, floods, drought, fire, epidemic, legislation, failure of ISP or telecommunications provider or any other cause beyond our reasonable control. This does not affect your statutory rights.
    • We reserve the right to close the Community Woodland Network at any time.
  12. Law, courts and language

    •  These Terms, use of the Community Woodland Network and services by us are governed by and to be interpreted in accordance with English and Welsh law. In the event of any dispute arising in relation to these Terms, use of our sites or in relation to the supply of any products or services by us the English and Welsh courts will have jurisdiction over the dispute. These Terms and the Community Woodland Network are provided in the English language only.

Forum Rules

These rules direct how members relate to one another in our community. They relate to the discussion forum and the personal messaging service. Please read these along with our website terms and conditions.

What is the forum for?

Our forum is a place where individuals and communities involved in planning, planting and managing community woodlands can share experiences, exchange views and support one another.
Who is it for?
The forum is here for anyone who is researching, planning, planting or managing a community woodland.

Be respectful

  • Remember that people on the forum may be having the best or worst day of their lives. Don’t attack or abuse others or inflame situations.
  • Disagreement is fine but harassment, intimidation or verbal abuse isn’t. Don’t treat people on the forum with less respect than you would if you were standing in front of them.
  • Don’t misrepresent yourself or pretend to be someone else. It breaks trust and hurts the community.
  • Don’t be hateful. Respect the gender, religion, ethnicity and race of others.
  • Give others the benefit of the doubt. If you’re offended by a post, consider whether the person who posted it meant to be offensive. People may simply be having a bad day.
  • Think before you post.
  • Remember that everyone is entitled to their opinion. Before making a post, consider that people interpret things in different ways and what may be innocent to one person could be offensive or upsetting to another. Similarly, you might disagree with something someone has posted, but that does not mean they’re wrong.
  • If you respond to a post you find offensive, read your response before you post it and consider whether it is reasonable or whether it will make things worse. You always have the option of reporting it to the forum team. Arguments on the forum upset other users, not just those involved.
  • DON’T SHOUT. Use CAPITALS sparingly. Using capital letters in posts is considered to be shouting. They can also be difficult to read. Only use bold, italics and underlining to highlight parts of your post.

No Spam / Advertising / Self-promotion in the forums

  • We define spam as unsolicited advertisement for goods, services and/or other web sites, or posts with little, or completely unrelated content. Do not spam the forums with links to your site or product, or try to self-promote your website, business or forums etc.
  • Spamming also includes sending private messages to a large number of different users.
  • DO NOT ASK for email addresses or phone numbers – Your account could be banned permanently and your posts will be deleted.
  • Keep it relevant
  • Be sure to post in the correct section of the forum and, if you must use links, make sure that they are relevant to the community. Keeping to the correct section means that your post is likely to be read by those who are interested. You’re also likely to get more responses. We sometimes remove links that have nothing to do with Community Woodlands.
  • Don’t post the same message in more than one section. In most cases, this stops the flow of conversation and can be quite boring for those who are looking through the latest activity. Still, there are times where this might be appropriate.
  • If you think this is something that you would like to do but you’re not sure whether it breaks the rules, contact the Forum Administrator for advice.

Stay safe

The forum is public and everything that is posted here can be found on search engines. People are not necessarily who they say they are on the forum. Keep yourself safe by sticking to the following rules:

  • Don’t share your passwords with others.
  • The terms of use of this website set out your legal obligations that you agree to when using this site. Be sure you know what they are. The document is long, but you’ll only have to read it once.
  • Only post content that you have written yourself. If you would like to share the work of another person that may be relevant, be sure to only use a short excerpt of the material and acknowledge the person who wrote it. If you would like to share the entire work, include a link to a place where other members can find it.
  • We will remove posts that breach copyright immediately.
    Moderation
  • Our team of moderators check the forum regularly to ensure that we are keeping to these guidelines and the terms of use. Where we can, we will try to moderate in a way that doesn’t interrupt the flow of conversation.

What happens if I see a thread/post which has broken a rule?

  • Please report the thread/post to admin
  • When you write to us – either by clicking on ‘Report post’ or by emailing communitywoodland@woodlandtrust.org.uk – we will get back to you as quickly as we can. During weekdays, this will normally be within two days.
  • Note that if several people report a post using the ‘Report’ link, we will only respond to the first person.
    What happens if I break a rule?
  • If you break a rule, then you will either be warned or banned. A ban of your user account may either be temporary or permanent.
    The administrators and moderators also have the right to edit, delete, move or close any thread or post as they see necessary, without prior warning.

How to complain

Forum members sometimes prefer to complain about (or compliment) us using the forum. It is valuable to some users to know that others are aware of their complaints. But this isn’t the best way to contact the charity about these issues.
